These Terms of Service (“Terms”) govern access to and use of the Lumeio website and recruitment intelligence platform (the “Platform”).

1. Definitions
- Lumeio”, “we”, “our”, or “us” means Lumeio Pty Ltd.
- “User” means any individual or organization using the Platform.
- “Employer” means an organization using Lumeio for recruitment purposes.
- “Candidate” means an individual whose data is processed through the Platform.
- “Services” means all features, tools, and functionality provided by Lumeio.
2. Eligibility & Use
You must be at least 18 years old to use the Platform.
You agree to:
- Use the Platform only for lawful recruitment-related purposes
- Comply with all applicable employment, privacy, and anti-discrimination laws
- Ensure any information you provide is accurate and lawful
3. Nature of the Services
Lumeio provides recruitment intelligence and decision-support tools only.
- Lumeio does not make hiring decisions
- Lumeio does not guarantee hiring outcomes
- Final employment decisions remain the sole responsibility of Employers
The Platform provides insights, rankings, and analysis to assist—not replace—human judgment.
4. AI & Human-in-the-Loop Processing
Lumeio uses artificial intelligence and human review to generate insights.
You acknowledge that:
- AI outputs are probabilistic and not infallible
- Human reviewers may review, validate, or override AI outputs
- Insights are advisory and informational only
Lumeio does not warrant that AI outputs are complete, accurate, or suitable for any specific hiring decision.
5. Candidate Data & Consent
Employers are responsible for:
- Obtaining lawful consent from Candidates
- Ensuring Candidates are informed about data processing
- Complying with applicable privacy and employment laws
By using the Platform, Employers represent and warrant that they have the legal right to upload and process Candidate data.
6. Video Interviews & Recordings
Where video interviews are enabled:
- Interviews may be recorded (audio and visual)
- Recordings may be analyzed by AI and reviewed by humans
- Access is restricted to authorized users
Candidates participate voluntarily and subject to Employer consent processes.
7. User Responsibilities
You must not:
- Use the Platform for discriminatory, unlawful, or unethical hiring
- Upload false, misleading, or unauthorized data
- Reverse engineer, scrape, or misuse the Platform
- Interfere with platform security or operations
8. Intellectual Property
All intellectual property rights in the Platform, including software, models, algorithms, and content, belong to Lumeio or its licensors.
You are granted a limited, non-exclusive, non-transferable right to use the Platform during your subscription term.
9. Confidentiality
Users agree to keep confidential:
- Platform outputs
- AI insights and analysis
- Any non-public information disclosed by Lumeio
This obligation survives termination of these Terms.
10. Fees & Subscription (If Applicable)
Fees, billing cycles, and subscription terms are specified in separate agreements or order forms.
Failure to pay may result in suspension or termination of access.
11. Suspension & Termination
Lumeio may suspend or terminate access if:
- These Terms are violated
- Use poses legal or security risks
- Required by law or regulation
Termination does not affect accrued rights or obligations.
12. Disclaimers
To the maximum extent permitted by law:
- The Platform is provided “as is” and “as available”
- Lumeio makes no warranties regarding accuracy, suitability, or outcomes
- We do not guarantee employment, hiring success, or compliance
Use of the Platform is at your own risk.
13. Limitation of Liability
To the maximum extent permitted by law:
Lumeio shall not be liable for:
- Hiring or employment decisions
- Loss of profits, business, or opportunities
- Indirect, incidental, or consequential damages
Our total liability is limited to the fees paid to Lumeio in the 12 months preceding the claim.
14. Indemnification
You agree to indemnify and hold harmless Lumeio from any claims, damages, or liabilities arising from:
- Your use of the Platform
- Violation of laws or regulations
- Employment decisions made using Platform insights
15. Compliance with Laws
Users are solely responsible for complying with:
- Employment laws
- Anti-discrimination laws
- Privacy and data protection regulations
Lumeio does not provide legal or HR advice.
16. Changes to the Services or Terms
We may modify the Platform or these Terms at any time.
Continued use constitutes acceptance of updated Terms.
17. Governing Law & Jurisdiction
These Terms are governed by the laws of Victoria, Australia.
You submit to the exclusive jurisdiction of the courts of Victoria.
